Port A Escapes Policies

  • Determine and agreed upon depending on the selected properties for the agreed-upon time period.
This rental agreement constitutes a contractual agreement between the guest and Port Aransas Escapes, LLC, d/b/a Port Aransas Escapes, hereinafter called PAE. This contract is enforceable when first payment has been received by PAE. In consideration of this mutual agreement, PAE will provide use of property for the period from [Check-in date] to [Check-out date].

Receipt of 25% of the total reservation cost is required to make a reservation. The final balance is due 30 days prior to arrival. A refundable cash security deposit may be required during holidays and spring break or at PAE’ discretion.

Check-in time starts at 4pm. A property that is a same-day turnaround on the day of your arrival will have a possible 5pm check-in time. Our office will be open from 9am-5pm Monday-Saturday and Sunday 10-4. Check out time is 11am, however, if available, you may arrange for a late check-out for a fee of $50 plus tax per hour. Any guest staying past 2:00pm will be charged for an additional night of rent. Late check-outs cannot be addressed until the morning of departure.

Cancellation more than 30 days prior to check-in will result in a $50 plus tax service charge and a return of the 25% deposit. Cancellations made at least 14 days to arrival will receive a 50% refund. Cancellations made less than 14 days to arrival will result in a full forfeiture of payment. We strongly encourage you to purchase CSA travel insurance to protect your vacation investment. There are no refunds for early departures. All monthly winter rentals must cancel with more than 30 days notice or will result in a full forfeiture of payment. If a winter rental is cancelled with more than 30 days notice, a refund will be issued minus a $50 cancellation fee.

Visa, MasterCard, cash or checks are accepted. If paying by check it must be received 10 days prior to due date and made payable to PAE. A valid credit card is required if paying by cash or check. The credit card will be charged the replacement cost for any broken or missing items on the property, as well as any additional cleaning fees and any cost of repairs. If you are arriving or departing before or after the 1st a prorated amount is due. Rates quoted do not include applicable lodging tax, Reservation Fee, pet fees, cleaning fees, trip insurance, early arrival fees or late departure fees if applicable.

Occupancy limits are posted on our web site and confirmed at time of reservation. If guest exceeds the occupancy limits, the guest will be asked to leave without a refund. Exceptions to the occupancy limit are only made for one infant under the age of two with prior approval. Additional visitors must also be pre-approved by PAE.

Contracting guests of PAE must be 25 years of age or older. The guest must have a State Driver’s License or other acceptable ID. PAE reserves the right to refuse service to anyone.

Pets are only allowed in pet-friendly properties. There will be a $20 per night or $100 per month, per pet, charge for all pets staying at pet friendly properties, unless otherwise stated.

All pets must always be leashed when at the beach or outside of the home. Pets must meet the guidelines set for that property or complex, such as weight limit, type, or maximum number of pets. If an unreported pet or a pet that exceeds the guidelines is found to be staying in a property, the guest will be charged $500 and be asked to leave without a refund.

All of the vacation rental properties are individually owned. Each property reflects the taste of each owner. PAE has made every effort to ensure property descriptions are accurate. However they are subject to errors or omissions and we cannot be held responsible for change of content and/or features, or removal by owner without notice.
Each property will be equipped with sheets for every bed. Sheets for sleeper sofas, futons, trundle beds and roll-away beds will be in the master bedroom closet. One bath towel and one wash cloth will be provided for the maximum occupancy of the unit. One hand towel will be provided in each bathroom. All towels and linens provided in the unit are accounted for. Any missing, damaged, or stained beyond repair items will result in charges to the credit card on file for the stay.

Complimentary amenities will be provided in the property as a convenience until you have time to shop. These items include a sponge, bath soap, dish soap, dishwasher detergent, laundry detergent, paper towels, toilet paper, and trash bags. These items will not be replenished during your stay.

Do not remove anything from the property. Do not take items from one property to another. This includes bath towels provided by PAE. These towels are not to be used at the pool or the beach. Each property is inspected (with an itemized list) upon departure. Anything missing from the property will be charged to the guest’s credit card on file for the stay.

Guest agrees to use only the parking spaces provided for the property. Offending vehicles will be towed at your expense without notice. All vehicles must be parked in the driveway. No motor homes, RV’s or pop-up campers are allowed at any properties. If staying in Mustang Royale or Royal Sands, no cars may be parked on the road – all vehicles must be parked in the driveway. Parking passes are required at Banyan Beach, Beachhead Condos, Courtyard Condos, Channelview Condos, Gulfside Condos, Gulf Waters, Mustang Island Beach Bungalows, Mercer Village, Pirates Bay, Royal Palm, Sea Isle Village, Sea Mist, and Village Walk. VEHICLES AND GOLF CARTS WITH NO PARKING PASSES WILL BE TOWED AT OWNERS EXPENSE.

PAE cannot predict construction or remodeling plans. You may book a property when construction is not underway, but it could begin prior to your arrival. We apologize for any inconvenience that may result. We have no control over these situations and are not able to issue relocations or refunds.

No loud music or parties at any property managed by PAE. Please respect your neighbors as you would in your own neighborhood. Renter shall not use rental or permit it to be used for any disorderly or unlawful purposes or in any manner that interferes with other residents. Violations of this rule could result in immediate eviction. Please observe speed limits at all times. Quiet hours are from 10pm to 8am. PAE is not responsible for the actions of other guests. Should you have a problem with noise coming from another unit please contact the police department at 361-749-6241.

Cleaning fees vary by property and are based on square footage. There will be a $50 charge for lock outs, extra keys, or non-returned keys. Each guest will be provided 2 keys per property at Check-in, if applicable. A $500 fine will be levied and immediate eviction for smoking in any property, no exceptions. Guests are welcome to smoke on the patios or decks outside. If the property is unusually dirty, the guest will be charged a $30 per hour cleaning fee, charged to your credit card.

Check the property carefully before leaving. PAE will not be responsible for items left in properties after check-out. Please notify us as soon as you realize you’ve forgotten something, and we will make every effort to locate and return lost and forgotten items when the property is unoccupied but there is no guarantee they will be found. If a guest leaves an item in the property and wishes to have it mailed back to them, they will be required to pay for the postage as well as a $25 service fee. Any forgotten items must be retrieved within 10 days, or they will be donated to a local charity.

All PAE properties are located on an Island and experience harsher than normal wear and tear due to the constant exposure to our environment. Maintenance issues, electrical failures, and mechanical failures are rare and unfortunate, and we regret any inconvenience that may result. However, we have no control over these situations and are not able to relocate, discount or refund guests for issues with air conditioners, elevators, dishwashers, refrigerators, washers, dryers, cable or satellite TV, internet access, electricity, DVD players, swimming pools, hot tubs, or any other appliances or amenities. Please report any inoperative equipment or concerns as they occur, and we will make every effort to resolve the problem as soon as possible.

Filling the property refrigerator with food and/or drinks will cause it to overwork and not cool properly. It is normal for the refrigerator to take up to 24 hours to cool. Adjusting the temperature setting to its highest setting will only cause the unit to freeze up. Service calls for non-cooling refrigerators will not be addressed until the following morning. Any seafood or meat must be properly wrapped when placed in the refrigerator.

We strongly recommend that guests purchase travel insurance for stays during hurricane season – June 1st through November 30th. In the event of a Mandatory Evacuation of Port Aransas, PAE will issue refunds or will move the reservation to alternative dates.

By signing this Rental Agreement, each guest acknowledges being offered insurance to compensate the guest for losses or damages resulting from loss of use of the property. If the guest refuses said offer to purchase travel insurance, the guest shall not be entitled to a refund of monies paid.

Unless caused by the homeowner, owner is not responsible for personal injuries or property damage caused to renter or renter’s guests or their property. Renter acknowledges the property may have bunk beds, the use of which is inherently dangerous. Renter assumes all liability for the use or misuse of said bunkbeds. PAE is not responsible for injuries to the renter or renter’s guests or their property for unforeseeable or dangerous use of the property. Renter agrees to indemnify PAE and hold harmless in the event of legal action against owners arising from renter’s use of the property or injuries that occur on the property that are not the fault of PAE.

Upon arrival the renter agrees to notify PAE of any damages to the property. Renter agrees to accept responsibility for all damage caused by negligence or willful disregard by renter or renter’s guests. The Reservation Fee covers up to $1,500 of accidental damage. The Reservation Fee shall be deemed invalid if the damage is not reported in writing to PAE prior to check-out. PAE is not responsible for renters’ or renters’ guest’s personal property.

This Reservation Fee covers unintentional damages to the rental unit interior that occur during your stay, provided they are disclosed to management prior to check-out, and covers a maximum amount of $1,500. Any damages not covered, or in excess of $1500, will be charged to the credit card on file. If, during your stay at one of our Rental Properties, a guest listed on the rental agreement causes any damage to real or personal property of the unit as a result of inadvertent acts or omissions, the cost of repair or replacement of such property up to a maximum amount of $1,500 will be covered. Damaged caused by a pet or negligence on the part of the guest is not covered by the Reservation Fee. Certain terms and conditions apply. The Reservation Fee is required for every stay at all of our Rental Properties and it is not refundable. Please contact PAE LLC if you have any questions or concerns about the Reservation Fee.

Representatives for PAE have the express right to enter the properties at any time, with or without the guest’s consent to inspect the property or perform routine maintenance. PAE will make attempt to notify the renter if this should occur.

Venue for any dispute arising out of this agreement or the rental period will lie exclusively in Nueces County, Texas. Should any legal action by owners become necessary to enforce this agreement, Renter agrees to pay all legal fees incurred by PAE, LLC, including costs and expenses.

Contracting guests of PAE must be at least 25 years of age and have a valid State Driver’s License or other acceptable ID.
